Objections are raised when the examiner believes that the claims do not meet the requirements of patentability or when there are formalities or procedural issues with the application.<\/p>\n\n\n\n<p>The objections typically point out deficiencies or inconsistencies in the claims, prior art references, or the description of the invention.<\/p>\n\n\n\n<p>You may respond to objections raised in office action in the following ways:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Arguments for objections, explanations, or clarifications,<\/li>\n\n\n\n<li>Doing required amendments,<\/li>\n\n\n\n<li>Or try to convince the examiner with additional proof and information<\/li>\n<\/ul>\n\n\n\n<p><strong>Based on the type of objection and its validity:<\/strong><\/p>\n\n\n\n<p>You may propose amendments to the claims to overcome the objections. In general, the claims are amended to reduce the scope by adding some limitations or clarifying the language to make them compliant with the patentability requirements.<\/p>\n\n\n\n<p>In other instances, you may need to do formalities or procedural corrections to overcome the objections. And some times you may need to provide additional information like experimental data, a working model to demonstrate the functionality of the invention or an expert opinion.<\/p>\n\n\n\n<p>Based on the response to objections received by the patent examiner, the examiner may:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>withdraw the objections, and proceed to grant or<\/li>\n\n\n\n<li>request further amendments or clarifications, or<\/li>\n\n\n\n<li>issue a final rejection<\/li>\n<\/ul>\n\n\n\n<p>The majority of patent applicants (inventors) will receive some type of objection based on the <a href=\"https:\/\/patentattorneyworldwide.com\/ca\/step-6-examination-of-patent-application\/\">examination report<\/a>. The objections raised on your patent application would be communicated with you, by official letter from the CIPO, known as an Office Action. You would get the opportunity to respond, make amendments or contest the objections raised within a given time.<\/p>\n\n\n\n<p>The best thing to do is analyze the examination report with the <a href=\"https:\/\/patentattorneyworldwide.com\/ca\/how-to-hire-right-patent-attorney-in-canada-for-patenting-your-invention\/\">patent agent\/attorney<\/a> and create a response to the objections raised in the examination report.<\/p>\n\n\n\n<p>Office action refers to the written document issued by the CIPO to highlight <strong>the examiner\u2019s review of a patent application<\/strong>. in general, the information in office action communicates the acceptance or rejection of claims and residing reasons, prior arts, or any other specific reasons for its rejection.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\"><strong>Time lines of the examination report and Response to objects<\/strong> <\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The examination report is shared to you after approximately 14 months from the request for examination. <\/li>\n\n\n\n<li>The time to respond to the examination report is upto 4 months from the date of mailing examination report.<\/li>\n\n\n\n<li>if you have requested for accelerated processing of application then you will get the examination report within 3 months from the examination and, you have 4 months to respond.<\/li>\n\n\n\n<li>after your response, it takes 5 to 9 months to consider your application.<\/li>\n<\/ul>\n\n\n\n<p>Writing a response to an Office action is a chance for invetor (with the help of patent agent\/attorney) to <strong>argue<\/strong> about the patentability of the application and comparative analysis (differentiation) of cited prior arts or some times <strong>comply<\/strong> to objections received by amending the patent application and making required changes so that the patent application would be granted.<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>Office action<\/td><td>&nbsp;<\/td><td>Responsibilities<\/td><\/tr><tr><td>Inventor<\/td><td><img decoding=\"async\" src=\"https:\/\/patentattorneyworldwide.com\/ca\/wp-content\/uploads\/2023\/01\/Inventor.png\" alt=\"\"><\/td><td>help the patent agent\/attorne in technical matters of invention (If required) with drafting response for objections.<\/td><\/tr><tr><td>Patent agent or attorney<\/td><td><img decoding=\"async\" src=\"https:\/\/patentattorneyworldwide.com\/ca\/wp-content\/uploads\/2022\/09\/Patent-Attorney.png\" alt=\"\"><\/td><td>draft the response to objections raised with the help of the inventor.
