or<\/li>\n\n\n\n<li>(f) that the applicant is an institution established by a Central, Provincial or State Act, which is owned or controlled by the Government; or<\/li>\n\n\n\n<li>(g) that the applicant is a Government company as defined in clause (45) of section 2 of the Companies Act, 2013 (18 of 2013); or<\/li>\n\n\n\n<li>(h) that the applicant is an institution wholly or substantially financed by the Government; or<\/li>\n\n\n\n<li>(i) that the application pertains to a sector which is notified by the Central Government on the basis of a request from the head of a department of the Central Government.<\/li>\n\n\n\n<li>(j) that the applicant is eligible under an arrangement for processing a patent application pursuant to an agreement between Indian Patent Office and a foreign Patent Office. <\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What qualifies for a startup?<\/h2>\n\n\n\n<p>\u201cStartup\u201d means (a) an entity in India recognized as a startup by the competent authority under Startup India initiative.<br>(b) In case of a foreign entity, an entity fulfilling the criteria for turnover and period of incorporation\/registration as per Startup India Initiative and submitting declaration to that effect.<\/p>\n\n\n\n<p>According to the Patents (Amendment) Rules, 2016 startups were defined as<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>entities that are working towards innovation, development, deployment or commercialization of new products, processes or services driven by technology or intellectual property where more than five years have not been lapsed from the date of incorporation\/registration with a maximum turnover of INR 25 crore per year.<\/li>\n\n\n\n<li>However, according to the Patent (Amendment) Rules, 2017, a startup can be any Indian entity recognized as a startup by the competent authority under the Startup India Initiative or a foreign entity that fulfills criteria for turnover and period of incorporation\/registration as per Startup India Initiative.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Under Startup India Initiative a Startup fulfills the following criteria:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>incorporated as a private limited company or registered as a partnership firm or a limited liability partnership in India;<\/li>\n\n\n\n<li>incorporated or registered in India not prior to ten years;<\/li>\n\n\n\n<li>turnover for any of the financial years since incorporation\/ registration has not exceeded INR 100 crores;<\/li>\n\n\n\n<li>has not been formed by splitting up or reconstruction of a business that was already in existence; and<\/li>\n\n\n\n<li>&nbsp;working towards innovation, development or improvement of products or processes or services, or if it is a scalable business model with a high potential of employment generation or wealth creation.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What if you do not qualify for startup?<\/h2>\n\n\n\n<p>If you are an individual or group of individual inventors or a legal entity other than startup, <strong>you can go for request for expedited examination<\/strong> if <\/p>\n\n\n\n<p>&#8221; you filled a PCT Patent cooperation treaty (international application) and selected India as a designated country as either International Searching Authority (ISA) or as an International Preliminary Examining Authority (IPEA)&#8221;
